1. Agreement to Terms

By accessing EXHENB Engineering’s website, entering into a service agreement, or engaging with our professional teams, you confirm that you accept these Terms of Service. If you do not agree, you may not use our services.

These terms apply to all clients, contractors, subcontractors, visitors, and stakeholders engaging with EXHENB Engineering.

2. Intellectual Property Rights

All designs, technical documentation, proposals, and project-related content generated by EXHENB Engineering remain the intellectual property of EXHENB unless otherwise agreed in writing.

  • All project drawings, reports, and deliverables are proprietary unless contractually transferred
  • Content may not be copied, reused, or modified without written consent
  • Our trademarks, logos, and brand assets may not be reproduced without authorization
  • Use of documentation is limited to agreed project scope

3. Client Accounts & Portals

Where applicable, clients may be provided with access to project portals or dashboards. Clients are responsible for ensuring the accuracy of information shared and for maintaining confidentiality of login credentials.

Important Notice

Any unauthorized access, misuse, or disclosure of project data will result in account suspension and may lead to legal action.

4. Prohibited Activities

Engagement with EXHENB’s services must remain professional and compliant with applicable laws. Prohibited activities include:

Misrepresentation of project data or credentials
Unauthorized sharing of proprietary reports or drawings
Attempts to compromise our IT systems or project portals
Use of our services for unlawful or unethical purposes

5. Disclaimers

EXHENB Engineering provides services with the highest professional and technical standards. However, certain factors remain outside our control:

We do not warrant that:

  • External approvals (e.g., government permits) will always be granted on schedule
  • Third-party dependencies (e.g., utilities, suppliers) will be uninterrupted or error-free
  • All risks (such as natural disasters or regulatory changes) can be eliminated

6. Limitation of Liability

EXHENB Engineering shall not be held liable for indirect, consequential, or incidental damages arising from service delivery, including delays caused by third-party suppliers, force majeure, or client-side mismanagement.

7. Indemnification

Clients agree to indemnify and hold EXHENB harmless from claims, damages, or liabilities that arise from misuse of services, breach of contractual obligations, or provision of inaccurate client data.

8. Termination

EXHENB reserves the right to suspend or terminate service delivery or access to client portals if these Terms are breached or if contractual obligations remain unmet.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law provisions.

10. Changes to Terms

EXHENB may update these Terms of Service periodically to reflect legal, technical, or operational changes. Updated versions will be published on this page.
